Welcome to Pracharwala.com (“Website” or “Platform”), operated by Pracharwala Limited,
having its registered address at Jangal Ramnagar, Amethi, Uttar Pradesh – 227405
(“Company”, “we”, “our”, “us”). These Terms and Conditions (“Terms”, “Agreement”) govern
your access to and use of the Pracharwala website, mobile application, and related services
(collectively referred to as “Services”).
By accessing, browsing, or using our Platform, you acknowledge that you have read,
understood, and agreed to be bound by these Terms, along with our Privacy Policy,
Refund & Cancellation Policy, and any other rules or guidelines that may be posted on the
Platform from time to time.
If you do not agree to these Terms, please do not access or use the Platform.
- Definitions
For the purpose of this Agreement:
● “User”, “You”, or “Your” means any person who accesses, browses, or uses our
Platform or Services in any manner.
● “Vendor” or “Business Owner” refers to any individual or entity that lists its
business, products, or services on Pracharwala.
● “Subscriber” means any user who purchases a paid listing plan or subscription on
the Platform.
● “Content” includes business listings, advertisements, text, images, audio, video,
reviews, and all other information uploaded or displayed on the Platform.
● “Platform” collectively refers to the Pracharwala website, app, and related web
properties. - Eligibility
To use the Services, you must:
● Be at least 18 years of age;
● Have the legal capacity to enter into a binding contract; and
● Use the Platform in compliance with applicable laws and regulations of India.
If you are registering on behalf of a business or organization, you represent that you have
the authority to bind that entity to these Terms. - Account Registration
To access certain features or services, you may need to register for an account on
Pracharwala.
● You agree to provide accurate, current, and complete information during registration
and to keep it updated.
● You are responsible for maintaining the confidentiality of your account credentials.
● Any activity under your account shall be deemed authorized by you.
● Pracharwala reserves the right to suspend or terminate any account that provides
false information or violates these Terms. - Services Offered
Pracharwala provides local business listings, promotional advertisements,
subscription-based visibility, and digital marketing services for small businesses.
Services may include:
● Business listings and directory search;
● Premium and subscription-based listings;
● Online advertisement display;
● Lead generation and customer inquiries;
● Website or profile promotion for registered businesses.
Pracharwala may modify, add, or remove services at any time without prior notice. - Subscription and Payments
- Payment Terms:
All paid services (subscriptions, ads, promotions) must be paid in advance.
Payments are processed through authorized payment gateways like Razorpay or
Paytm for secure transactions. - Invoices and Receipts:
Upon successful payment, a digital receipt or invoice will be sent to the registered
email address. - Renewal and Cancellation:
○ Subscriptions automatically expire at the end of the plan duration unless
renewed manually.
○ Pracharwala is not obligated to provide reminders for renewal. - Refunds:
Refunds, if applicable, will be processed only as per the Refund & Cancellation
Policy. - Business Listings and Content
- You agree to provide only truthful, accurate, and lawful information about your
business. - You are solely responsible for the content you upload or display on Pracharwala.
- Pracharwala reserves the right to review, verify, or remove listings that are
inaccurate, misleading, or violate any law. - You grant Pracharwala a non-exclusive, royalty-free, worldwide license to use,
display, and promote your content for business and marketing purposes. - Prohibited Uses
You agree not to use the Platform for any unlawful or prohibited activity, including but not
limited to:
● Uploading or distributing obscene, defamatory, or harmful content;
● Violating intellectual property rights of others;
● Posting false or misleading advertisements;
● Attempting to hack, damage, or interfere with the Platform;
● Sending spam, phishing, or fraudulent messages;
● Impersonating any person or organization.
Pracharwala reserves the right to suspend or permanently ban any user violating these
provisions. - Intellectual Property Rights
All content, design, layout, graphics, logos, icons, and software on Pracharwala are the
exclusive property of Pracharwala Limited.
No user is permitted to reproduce, distribute, or modify any material from the Platform
without prior written consent. - Limitation of Liability
To the maximum extent permitted by law, Pracharwala and its affiliates shall not be liable for
any:
● Indirect, incidental, or consequential damages;
● Loss of business, revenue, or data;
● Errors, interruptions, or unauthorized access on the Platform.
Your sole and exclusive remedy for dissatisfaction with our Platform is to discontinue its use. - Indemnification
You agree to indemnify and hold harmless Pracharwala, its employees, and affiliates against
any claims, damages, or liabilities arising from:
● Your use of the Platform;
● Violation of these Terms; or
● Infringement of third-party rights. - Termination
Pracharwala reserves the right to suspend, restrict, or terminate your access to the Platform
without notice if:
● You violate these Terms;
● Engage in fraudulent or illegal activity; or
● Cause harm to other users or Pracharwala’s reputation.
Termination does not relieve you of your obligations to pay any pending fees. - Privacy and Data Protection
Your use of the Platform is also governed by our Privacy Policy, which explains how we
collect, use, and protect your information.
By using Pracharwala, you consent to our data collection and handling practices as stated
in the Privacy Policy. - Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
In case of any disputes, the Courts of Amethi, Uttar Pradesh, shall have exclusive
jurisdiction. - Modification of Terms
Pracharwala may revise or update these Terms at any time.
Revised Terms will be effective once published on the Platform.
